Amendments to the Rules of Court
Amendments to the Rules of Court (Cap 322, R 5, 2006 Rev Ed) (“the Rules”) were gazetted on 20 February 2009 and came into effect on 1 March 2009. The main amendments to the Rules were introduced as a consequence of amendments to the Civil Law Act (Cap 43, 1999 Rev Ed). Order 1, Rule 4(3) of the Rules was amended to make clear that references to minors and persons under disability in the Rules are subject to section 36 of the Civil Law Act. Order 76, Rule 1 of the Rules was amended to bring the new Order 1, Rule 4(3) to the attention of the user.
Further amendments to the Rules were also made as a result of amendments to the Administration of Muslim Law Act (Cap 3, 2009 Rev Ed). Section 53(2) of the Administration of Muslim Law Act, which provides for the registration of Syariah Court orders in a District Court for the purposes of their enforcement, was repealed. Accordingly, Order 84B of the Rules relating to the registration of Syariah Court orders became redundant and was deleted.
